Law360 (November 7, 2022, 9:38 PM EST) — The U.S. Postal Service has asked a New York federal court to extend the stay of environmentalists and a union’s lawsuit alleging it overlooked climate change impacts when it decided to replace its aging delivery fleet with fossil fuel-powered vehicles.
The Natural Resources Defense Council and the United Auto Workers union have one of three lawsuits that each allege the Postal Service, at the behest of Postmaster General Louis DeJoy, in February 2021 inked a contract to purchase vehicles before undertaking an appropriate environmental review, in violation of the National Environmental Policy Act. Under the contract, 90% of new vehicles were set to be powered by internal combustion engines, but the Postal Service said Friday in a motion seeking an extended stay of litigation that that’s changed, and it needs more time to process the new plan.
