Law360 (August 15, 2022, 6:42 PM EDT) — A New York federal judge on Monday refused to toss a former mail carrier’s suit alleging she was fired for requesting a lighter workload while pregnant, saying a reasonable jury could find that the U.S. Postal Service ignored potential ways to address her doctor’s restrictions without limiting her hours.
In a 43-page opinion, U.S. District Judge Margo K. Brodie rejected USPS’ bid for summary judgment, saying it’s unclear whether the agency looked into any potential accommodation for Svetlana Shkolnikova prior to the official interactive process meant to aid employers and workers in finding reasonable accommodations.
