NLRB Judge Rules USPS, Union Didn’t Mishandle Firing

Law360 (September 29, 2022, 6:40 PM EDT) — The U.S. Postal Service lawfully suspended and fired a mail carrier who filed numerous grievances against the agency, and the employee’s union did not break federal labor law when it failed to help her file a grievance over her termination, a National Labor Relations Board judge said.

Lucas Patrick, the postmaster of a facility in Oak Hill, Ohio, had four opportunities to fire mail carrier Kandi Marcum between 2020 and 2021, when she repeatedly broke USPS safety rules while working for the facility, NLRB Administrative Law Judge Charles J. Muhl wrote on Wednesday in dismissing the general counsel’s complaint.

Instead, Patrick gave Marcum multiple chances to improve before finally terminating her in September 2021.
