A postal worker’s Second Amendment right to carry a gun was violated when he was charged with a felony for having his gun at work, a federal court said.
Emmanuel Ayala had a Florida permit to carry a concealed weapon when he was arrested at work and charged with possessing a firearm in a federal facility in violation of 18 U.S.C. §930(a). He argued that the statute was unconstitutional, as applied to him, and Judge Kathryn Kimball Mizelle of the US District Court for the Middle District of Florida agreed.
