New Proposal Made on Long-Running Dispute over Division of FERS Supplement in Divorce

Newly offered legislation in the Senate (S-4290) would specify that a FERS retiree’s “special retirement supplement” may be divided in a divorce order that awards a share of retirement benefits to the former spouse only if the order explicitly requires dividing the supplement, the latest development in a long-running dispute.

The bill, introduced on a bipartisan basis by Sens. James Lankford, R-Okla., and John Fetterman, D-Pa., addresses a back and forth spanning a decade regarding that supplement, which sometimes is called simply the “FERS supplement” or the “annuity supplement.”
