CLEVELAND – A federal judge is refusing to throw out some of the evidence against the men accused in the 2024 killing of a Warren mail carrier.
U.S. District Court Judge Donald Nugent on Wednesday denied motions filed by Kaprise Sledge and his father, Thomas, who are scheduled to go on trial August 17 on murder and firearm charges.
The charges stem from the March 2024 shooting death of postal worker Jonte Davis in Warren.
Defense attorneys previously filed motions to suppress search warrants obtained using cell phone data and tracking information, claiming investigators gathered the evidence through what they described as an unlawful “digital dragnet” that violated their client’s constitutional rights and was an overly broad invasion of privacy.
Following a hearing on Wednesday, Judge Nugent denied the motions to suppress, ruling that the warrants were properly obtained by investigators and were narrowly tailored geographically and only temporarily for this case.
“Thus, affidavits established probable cause for the appropriate issuance of the search warrants in question,” wrote Judge Nugent in his docket entry.
