11th Circ. Won’t Revive Mail Carrier’s Retaliation Suit

Law360 (September 20, 2022, 8:54 PM EDT) — The Eleventh Circuit on Tuesday upheld the U.S. Postal Service’s win in an ex-worker’s suit alleging he was fired for complaining about how a manager treated him after they ended a romantic affair, saying he hadn’t overcome the trial court’s rationale for nixing his suit.

A three-judge panel said U.S. District Judge Kristi K. DuBose granted summary judgment to the U.S. Postal Service on three grounds, but Schwayn Bradley only rebutted two of them — an omission that is fatal to his appeal.

The appeals panel cited the Eleventh Circuit’s 2014 decision in Sapuppo v. Allstate Floridian Insurance Co. , where the court ruled that to reverse a district court order based on multiple independent grounds, a party must refute each determination.
