Foster says she “suffered physical pain, starvation, severe emotional and mental anguish, and anxiety during her 24-hour entrapment” and feared for her life due to her diabetic condition.
The alleged incident happened on August 26, 2023 at 50 Main Street at City Square. The site is part of a one-square-block office-retail-apartment complex, cattycorner to the Metro-North train station, built and managed by Ginsburg Development Companies of Valhalla. Allied provided security and ABM handled maintenance, according to the complaint.
Foster was at the building at 11:40 a.m. on Saturday, Aug. 26, 2023 to deliver mail when she realized she needed to use a bathroom, according to the complaint. The ground floor has no bathroom, she “knew” that the second-floor bathroom door was unsecured, and a security guard allowed her to take the elevator to the third-floor bathroom.
Foster claims that the lock on the third-floor bathroom malfunctioned and trapped her inside.
She had left her cell phone in her mail bag in the mailroom, the complaint states. So she tried to get help by banging on the door, calling out, and writing notes on paper towels that she slid under the door.
She says she had no food, water or medication, putting her at risk for life-threatening complications because of her diabetic condition.
The postal service noticed her absence and alerted police, according to the complaint. Officers canvassing the area arrived at the building hours later but the security guard allegedly failed to tell police that he had permitted Foster to use the bathroom and claimed he had no recollection of seeing her.
